Wie Arne auch schon berichtete will man anscheinend neue Gesetze in Canada einführen, die die Tötung von Frauen unter bestimmten Umständen anders bestrafen als die gleiche Tat bei einem Mann:
The Liberal government has tabled sweeping new legislation that it says will protect victims and survivors of sexual and intimate partner violence and protect children from predators.
(…)
The legislation tackles intimate partner violence by making hate-motivated murder a first-degree offence even if it was not deliberate or planned.
Cases of femicide, the killing of a woman or girl, will be considered first-degree murder even if the crime was not planned or deliberate if it can be proved that the victims were subject to a pattern of abuse or coercive control.
The benchmark for establishing that level of abuse requires a court to agree that a reasonable person in the same circumstance would be considered by the court to be controlled or abused, not that the specific victim felt they were being abused or controlled.
Ich habe mir den Änderungsvorschlag mal hier angeschaut und wenn ich richtig verstehe, dann bezeichnet man zwar bestimmte Fälle als Femizid, die Tat selbst ist aber anscheinend neutral definiert. Ich zitiere mal:
Aus der Einleitung:
It amends the Criminal Code to, among other things,
(a) create a new offence that prohibits engaging in a pattern of coercive or controlling conduct toward an intimate partner;
(b) provide that, in the following circumstances, murder — known as femicide when committed against a female person — is murder in the first degree:
(i) the murder is committed against an intimate partner in the context of a pattern of coercive or controlling conduct,
(ii) the murder is committed in the context of sexual violence,
(iii) the murder is committed in the context of human trafficking, or
(iv) the murder is motivated by hate;
Und der eigentlich einzufügende Paragraph:
Femicide, including of intimate partner, and other aggravated circumstances

(5.1) Irrespective of whether a murder is planned and deliberate on the part of any person, murder is first degree murder when the death is caused by that person

(a) while engaging in, or after having engaged in, a pattern of coercive or controlling conduct with intent to cause the victim to believe that the victim’s physical or psychological safety is threatened, in the case where the victim is that person’s intimate partner;
-
(b) while exercising control, direction or influence over the movements of the victim with intent to exploit the victim, within the meaning of section 279.04;
-
(c) while committing or attempting to commit an offence of a sexual nature or an offence for a sexual purpose; or
-
(d) while motivated by hate based on colour, race, religion, national or ethnic origin, age, sex, sexual orientation, gender identity or expression, or mental or physical disability.

(2) The court that imposes a sentence for manslaughter shall consider imposing a sentence of imprisonment for life if the person committed the manslaughter
-
(a) while engaging in, or after having engaged in, a pattern of coercive or controlling conduct with intent to cause the victim to believe that the victim’s physical or psychological safety is threatened, in the case where the victim is that person’s intimate partner;
-
(b) while exercising control, direction or influence over the movements of the victim with intent to exploit the victim, within the meaning of section 279.04;
-
(c) while committing or attempting to commit an offence of a sexual nature or an offence for a sexual purpose; or
-
(d) while motivated by hate based on colour, race, religion, national or ethnic origin, age, sex, sexual orientation, gender identity or expression, or mental or physical disability.
Wenn ich es richtig verstehe, dann werden da also Mann und Frau gleich behandelt. Das ist schon meist die Folge davon, dass man sonst Ärger mit dem Gleichbehandlungsgrundsatz im Strafrecht bekommt und auch nur schwer zu begründen ist, warum man jemanden anders bestraft, wenn er eine Frau tötet statt eines Mannes.
Aber natürlich wird es als Gesetz verkauft, welches insbesondere Femizide verhindern soll und zum Schutz von Frauen da ist (was der Häufigkeit nach in der Tendenz ja auch durchaus sein könnte.)
